Underride crashes occur when a passenger vehicle slides beneath a truck trailer during a collision — typically because the truck stopped or slowed suddenly, or because inadequate underride guards allowed the vehicle to pass under the trailer. Federal regulations (49 CFR §393.86) require rear underride guards on trailers. When a guard is absent, defective, or fails to prevent a passenger vehicle from sliding under the trailer, both the carrier and the trailer manufacturer may be liable. These crashes cause decapitation-height injuries that are disproportionately fatal or catastrophic. We have handled underride cases in Tarrant County and across Texas.
